Terms of Service

These terms apply when you use Baseballista from the United States. They sit alongside our Privacy Policy.

1. Who we are and what these terms cover

Baseballista is a baseball team management service operated by AD Média, a business based in France (SIRET 91193070900017, 14 Allée des Bois, Lormont, France). In these terms, "Baseballista", "we", "us" and "our" mean AD Média. "You" means the person using the service, and, if you sign up for a team or club, that team or club.

The service is available at baseballista.com and app.baseballista.com. By creating an account or using the service you agree to these terms. If you do not agree, do not use the service.

2. The service

Baseballista lets coaches and teams manage a roster, schedule games and practices, build lineups, track game statistics and message team members. Features depend on your plan. We may change, add or remove features over time. If we remove a feature that a paid plan clearly included, we will tell you and, where it is fair to do so, adjust or refund the affected period.

3. Eligibility and accounts

  • You must be at least 18 years old to create a coach account or to buy a paid plan.
  • Player accounts are intended for players aged 13 and over. Children under 13 should not create an account. A coach or club administrator may record roster information about a player under 13 only with the permission of that child's parent or legal guardian (see section 6).
  • Give us accurate information and keep your login details private. You are responsible for activity on your account. Tell us promptly at contact@baseballista.com if you think your account has been used without permission.
  • A coach invites players and other coaches. The coach who creates a team is responsible for who is invited and for the information entered about them.

4. Plans, billing and cancellation

Baseballista has a free Starter plan and paid Club and Pro plans. Current prices, limits and features are on our pricing page. Player accounts are free.

  • Currency and taxes. US customers are charged in US dollars. A customer keeps the currency of their first subscription. Listed prices do not include sales, use or similar taxes, which are added where required.
  • Payments. Payments are processed by Stripe. We do not store your full card number. By subscribing you authorize recurring charges to your payment method until you cancel.
  • Renewal. Paid plans renew automatically each month or year, depending on the interval you chose, at the then-current price. We will give you advance notice of a price increase, and it will apply from your next renewal.
  • Upgrades and changes. You can change plans in your account settings. When you upgrade mid-period, the first charge is prorated.
  • Cancellation. You can cancel at any time from your account (the billing portal). Cancellation takes effect at the end of the period you have already paid for, and your plan then returns to Starter.
  • Refunds. Except where the law requires otherwise, fees already paid are not refundable. If you believe you were charged in error, write to us within 30 days and we will review it in good faith.
  • Plan limits. If your account is over a plan's limits, for example after a downgrade, we may restrict adding new items until you are within the limits. We do not delete your data for that reason.

5. Your content and your team's data

You keep ownership of everything you put into Baseballista, including rosters, lineups, statistics, schedules, messages and photos ("your content"). You give us a limited, non-exclusive license to host, copy, display and process your content only as needed to run and improve the service for you and the people you invite. We do not sell your content and we do not use it for third-party advertising.

You are responsible for your content and for having the right to share it, including any permission needed to share information about other people. Messages and photos in team chat are visible to the members of that team. Some features, such as a public live-game link, make selected game information visible to anyone who has the link, so use them knowingly.

You can export your data from the app where an export feature is included in your plan, and you can ask us to delete your account and data at any time (see our Privacy Policy).

6. Children and minors

Youth teams are a normal use of Baseballista. If you add a player who is under 13, you confirm that you are the child's parent or legal guardian or that you have their parent's or guardian's permission to record the information you enter. You should enter only the information you need to run the team. A parent or guardian can contact us at any time to review, correct or delete information about their child. We do not knowingly collect personal information directly from children under 13. If you believe a child under 13 has created an account, contact us and we will remove it.

7. Acceptable use

Do not use Baseballista to:

  • break the law, or infringe or violate anyone's rights;
  • harass, threaten, bully or harm others, or post content that is unlawful, hateful, sexually explicit or that exploits minors;
  • send spam, or use messaging to contact people who have not agreed to hear from you;
  • try to access accounts, data or systems you are not authorized to use, or probe, scan or test the service's security without our written permission;
  • interfere with or overload the service, or use bots or scrapers to copy it;
  • reverse engineer the service, or resell or sublicense it except as these terms allow.

We may remove content or suspend access that breaks these rules. Where it is reasonable to do so we will warn you first.

8. Our property

The Baseballista service, including its software, design, logo and text, belongs to AD Média and is protected by intellectual property law. These terms give you a personal, limited, revocable right to use the service while you comply with them. If you send us feedback or suggestions, we may use them freely without owing you anything.

9. Third-party services

Baseballista relies on third-party providers, for example for hosting, sign-in, payments and email. Their own terms apply to your use of their services, and we are not responsible for their acts or outages.

10. Availability and changes to the service

We work to keep Baseballista available, but we do not promise it will be uninterrupted or error free. We may perform maintenance, and the service can be affected by things outside our control.

11. Suspension and termination

You can stop using Baseballista and delete your account at any time. We may suspend or end your access if you materially break these terms, if your use creates legal or security risk, or if required by law, and we will explain why where we reasonably can. When an account ends, sections of these terms that by their nature should continue (such as ownership, disclaimers, liability and dispute terms) continue to apply.

12. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Statistics and metrics (including WAR) are calculated from the data you enter and are indicative: they are not a substitute for your own judgment, and you are responsible for lineup, playing-time, health and safety decisions. Some states do not allow certain disclaimers, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent the law allows, AD Média and its owners and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us for the service in the 12 months before the event giving rise to the claim, or (b) US$100. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or any rights you have under mandatory consumer protection laws where you live.

14. Indemnity

If you use the service for a business or club, you agree to defend and compensate us against claims by third parties arising from your content or your breach of these terms, to the extent allowed by law. This section does not apply to individual consumers where the law does not permit it.

15. Governing law and disputes

These terms are governed by the laws of France, without regard to its conflict-of-law rules. Before filing a claim, please contact us at contact@baseballista.com and give us 30 days to try to resolve it informally. If we cannot, the courts of Bordeaux, France have jurisdiction, except that if you are a consumer in the United States you may also bring a claim in the courts of your state of residence where the law gives you that right. Nothing here takes away mandatory consumer rights you have under the law of the state where you live.

16. Changes to these terms

We may update these terms. For material changes we will notify you in the app or by email before they take effect, and the "Last updated" date above will change. If you keep using the service after the change takes effect, you accept the new terms. If you do not agree, you can cancel and close your account.

17. General

These terms and our Privacy Policy are the whole agreement between you and us about the service. If a part is found unenforceable, the rest stays in effect. If we do not enforce a right right away, we have not given it up. You may not transfer your account or these terms to someone else without our written consent. We may transfer ours as part of a merger, sale or reorganization.
